Vineyard Holidays agrees to act as letting agent for the property owners (The Owner). The Property is offered for rental by Vineyard Holidays to the renter ("The Client) under the following conditions.
1. The Terms and Conditions set out below govern all bookings made by Vineyard Holidays. Our fees are 15% of the total rental cost. These charges may be liable to change, but not without prior notice. 2. Vineyard Holidays undertakes to design and build the advertising material for the rental property and display it on their website Free of Charge for life or until we are notified in writing to remove it. Although a proof copy of the advertisement will be given to the Owner or an electronic link provided to it, Vineyard Holidays reserves the right to change or modify the advertisement without prior notice to the Owner. Advertisements or amendments, will be displayed on the Internet within 5 working days of an agreed proof being received at our offices The copyright of all advertising material designed by Vineyard Holidays on behalf of its owners is strictly the property of Vineyard Holidays and may not be used by any third party without our express permission. 3. Prices cannot be changed for any reason once a booking is confirmed and a deposit is paid. 4. The 25% deposit payment is non refundable. Payment for the full amount is due 8 weeks before arrival. If a client cancels within 8 weeks of departure, they will not be entitled to a refund. Vineyard Holidays will endeavour to find a replacment letting for owners. If such a replacement is found, the client will be refunded monies paid less a handling charge. 5. Vineyard Holidays does not under any circumstances undertake to organise or arrange "Change Over Cleaning", Cleaning or Maintaining of Client's Swimming Pools, nor taking or return payments as "Breakage Deposits". This must be organised by the Owner or the Owner's representatives. We will notify the client if a Breakage deposit is required and inform them that it must be paid on arrival. Vineyard Holidays will not become directly involved in any disputes arising from the failure to reimburse such deposits, but may be called upon as an independent arbiter if necessary. The property must at all times be clean and tidy and in a fit condition to receive our Clients. 6. Owners agree to inform Vineyard Holidays at their earliest convenience of changes to their availability. Vineyard Holidays accepts no responsibility for any loss of revenue which may result from the lack of such notification. Owners may be liable under the EEU Trade Descriptions Act, should they make any false statements or misrepresentation. Owners may also be liable under the EEU Consumer Protection Act 1987, if they do not ensure that the prices advertised are a true reflection of prices charged. 7. Vineyard Holidays cannot be held responsible for any errors or omissions in any advertisement. Vineyard Holidays undertakes to accurately reproduce all advertisements submitted, but cannot be held responsible for any loss or damaged incurred as a result of errors or omissions. Vineyard Holidays reserves the right to refuse any advertisement and will not be held responsible for any expenses or losses incurred. Vineyard Holidays undertakes to safeguard all material supplied to us. Vineyard Holidays will remove any advertisement within 48 hours of receipt of a written request from the owner. 8. Vineyard Holidays cannot accept liability in any circumstances where performance of the contract is prevented by reason of: War or threat of war, riots, civil strife, terrorist activities, industrial disputes, natural or nuclear disasters, fire, flood or adverse weather conditions, acts of God, closure of ports or airports, epidemics, government action, failure to meet transport timetables or any similar events outside our control.
